I. Purpose of the implementation plan
Entrepreneurs are precious wealth, an important subject of economic activity. To create a law-based environment, market circumstances and social atmosphere conducive to the entrepreneurship and innovation for entrepreneurs, so that they will be given real status, honor and respect, and their enthusiasm, initiative and creativity will be mobilized, the central government and the provincial government successively issued the Implementation Opinions on Creating a Healthy Environment for Entrepreneurs to Develop and Promoting Excellent Entrepreneurship to Give Better Play to the Role of Entrepreneurs. In order to implement the central and provincial implementation opinions, Huai'an issued the Implementation Plan for Creating a Healthy Environment for Entrepreneurs and Promoting Excellent Entrepreneurship to Give Better Play to the Role of Entrepreneurs.
II. Main contents of the implementation plan (27 articles in seven aspects)
1. To create a law-based environment to protect the legitimate rights and interests of entrepreneurs according to law (4 articles in total). It is mainly about the full implementation of Opinions on improving the system of judicial protection of property rights to protect property rights in accordance with law, punishing illegal and criminal acts that violate property rights, accepting and handling cases such as property rights dispute appeals in time, improving the mechanism for protection of intellectual property rights, warning of infringement and case investigation, and promoting the implementation of the punitive compensation system for intellectual property infringement to increase the cost of intellectual property infringement.
2. To create a market environment that promotes fair competition and honest management of entrepreneurs (6 articles in total). It is mainly about further fulfilling the main responsibility for fair competition review, strictly enforcing the uniform standards for fair competition review, fully implementing the negative list system for market access, carrying out anti-price monopoly work, strictly investigating and punishing the abuse of administrative power to exclude and restrict competition, establishing the identification, collection and publicity system for the "red list" of good faith and the "black list" of dishonesty, and improving the regulation and standardization level.
3. To create a social atmosphere that respects and encourages entrepreneurs to start their own businesses (4 articles in total). It is mainly about further regulating political and business exchanges, building a communication mechanism between public officials and private enterprises, creating a cultural and social atmosphere that encourages innovation and tolerates failure, and providing more understanding, tolerance and help to entrepreneurs who make mistakes in their legitimate business operations. It is also about strengthening the encouragement of social honor for entrepreneurs and enhancing their sense of honor, and strengthening publicity and reports on achievements and contributions made by outstanding entrepreneurs.
4. To carry forward the excellent entrepreneur spirit and give better play to the role of entrepreneurs (3 articles in total). It is mainly about carrying forward the entrepreneur's spirit of patriotism and dedication, encouraging the entrepreneurs to observe disciplines and obey laws and maintain the spirit of hard struggle, carrying forward the spirit of developing with innovation and pursuing quality, stimulating their vitality and potential in innovation, guiding entrepreneurs to carry forward the spirit of craftsman, encouraging them to focus on areas of expertise, and strengthening enterprise quality management. It is also about improving the mechanism for entrepreneurs to participate in the implementation of major national, provincial and municipal strategies, and encouraging and guiding them to actively participate in the construction of "Belt And Road", Yangtze River Economic Belt, Jianghuai Ecological Economic Zone, Huai River Ecological Economic Belt and Grand Canal Cultural Belt.
5. To strengthen high-quality, efficient and pragmatic services for entrepreneurs (4 articles in total). It is mainly about deepening the reform of non-face-to-face examination and approval (services), improving the "35745" centralized examination and approval service mechanism, further deepening administrative reform, improving the mechanism for discussion and exchange between municipal leaders and private entrepreneurs, establishing a system for municipal leaders contacting with private entrepreneurs, improving the mechanism for discussion and regular consultation between government departments and private entrepreneurs, establishing a centralized disclosure system and a push system for information related to enterprises and setting up an open platform for government information resources.
6. To strengthen the cultivation of outstanding entrepreneurs (3 articles in total). It is mainly about promoting the cooperation and exchange between municipal state-owned enterprises and central and provincial state-owned enterprises to share development experience, vigorously implementing the strategy of strengthening enterprises with talents, thoroughly implementing the municipal "science and technology entrepreneur cultivation project", guiding innovation resources to gather in science and technology enterprises, improving the strategic planning ability, collaborative innovation ability, team management ability and global outreach ability of the new generation of entrepreneurs, improving the municipal training system for entrepreneurs, strengthening cooperation with well-known colleges and universities and first-rate training institutions, implementing the project of improving the quality of entrepreneurs, and further promoting the initiative of "entrepreneurship for all and the rise of Huai'an businessmen".
7. To strengthen the party's leadership in the construction of entrepreneur team (3 articles in total). It is mainly about adhering to the party's leadership over state-owned enterprises, comprehensively strengthening the party building in state-owned enterprises, giving play to the leading role of party organizations in state-owned enterprises, educating and guiding private entrepreneurs to support party leadership and party building in enterprises, strengthening the party building in chambers of commerce, improving the system and mechanism for party building in private enterprises, and strengthening the political leadership role of party organizations in private enterprises. In creating a law-based environment that protects the lawful rights and interests of entrepreneurs, the principle of prudence, civilization and standardization is clearly adhered to in handling economic cases and it is strictly prohibited to take compulsory measures beyond the scope.
2. Independent trademark brand construction channels are more flexible and diversified. On the aspect of promoting excellent entrepreneur spirit and giving better play to the role of entrepreneurs, in guiding the entrepreneur to carry forward craftsman spirit, strengthening the international trademark registration in Madrid and optimizing the trademark brand structure are added to further expand the channels for the construction of independent trademark brand in Huai'an.
3. Evaluation of the effect of policies involving enterprises is more objective and fair. In terms of enhancing high-quality, efficient and pragmatic services for entrepreneurs, a third-party evaluation mechanism for the effect of policy implementation is added in the formulation of policies related to enterprises. The third-party evaluation not only reflects the openness and transparency of the government in formulating policies related to enterprises, but also can evaluate the effect of policy implementation scientifically, objectively and independently.
4. The improvement measures of party building in enterprises are more practical and operable. On the aspect of strengthening the party's leadership in the construction of the entrepreneur team, based on the provincial document's in-depth implementation of strengthening foundation and improving quality of the party construction in state-owned enterprises, the implementation plan of Huai'an innovatively proposed the innovation and excellence initiative project of the party construction to promote the improvement of the party construction project.
