On October 25th, the Huai'an government held a press conference to officially announce the release of the 2023 edition of the Enterprise-Friendly Exemption and Light Penalty List by the end of October this year. In comparison to the 2022 version, the new edition demonstrates a significant expansion in its coverage, with the number of responsible departments increasing from 22 to 31, representing a growth of 40.9%. The list of items has also expanded from 512 to 798, indicating a 55.9% increase, positioning Huai'an at the forefront of Jiangsu Province.
The 2023 edition boasts three major characteristics. Firstly, the scope of compilation has been broadened to encompass nine new areas, including commerce, education, sports, and local finance. Secondly, some items from the original list have been removed to make the new list more adaptable to the needs of market entities. Out of the 798 confirmed items, 493 are exempted from penalties, 207 receive light penalties, and 98 face reduced penalties. Thirdly, various measures, such as comprehensive training, case file reviews, city-wide announcements of exemplary cases for inclusive and prudent regulatory enforcement, and the inclusion of the execution status of the city-level three lists in the assessment of the business environment for counties and districts, have been employed to enhance the execution rate of the new list.
In January of the previous year, Huai'an issued a document to further advance inclusive and prudent regulatory enforcement throughout the city. The 22 city-level departments jointly released an Enterprise-Friendly Exemption and Light Penalty List, comprising 512 items exempt from penalties and items subject to light or reduced penalties. Through strengthened measures in construction, management, and utilization, as of the third quarter of this year, Huai'an has processed 19,800 cases using the list, relieving enterprises of a total burden of 326 million yuan. In the "Private Enterprises Assessing the Business Environment" activity conducted by the All-China Federation of Industry and Commerce in 2022, the satisfaction level with administrative law enforcement in Huai'an rose to the second place in Jiangsu Province.
This year, in the "Implementation Opinions on Accelerating the Construction of the 'Four Best' Business Environment" presented by the Municipal Party Committee and the Municipal Government, it is explicitly stated that three projects, namely, "full coverage of government agencies preparing enterprise-friendly, inclusive, and prudent enforcement lists," "full coverage of work items preparing enterprise-friendly, inclusive, and prudent enforcement lists," and "full coverage of work areas implementing enterprise-friendly, inclusive, and prudent enforcement," should be implemented. The requirements for implementing the 2023 edition of the Enterprise-Friendly Exemption and Light Penalty List are also outlined, with the aim of further promoting the regularization of administrative law enforcement behavior, enhancing the level of law enforcement services, and expediting the construction of the "Four Best" business environment.
